The ZBA is formed pursuant to NYS Town Law §267. The Board is comprised of 7 members each serving a 5 year term. Meetings of the Board are open to the public and minutes are prepared. The Board hears and decides appeals from and review of any order, requirement, decision or determination made by an administrative official charged with the enforcement of any ordinance adopted pursuant to Article 16 of New York State Town Law, for example, Town Zoning Regulations or Planning Board decisions. Residents typically come before this Board primarily for zoning variances. Example: The new porch you wish to add to your home doesn’t meet the setback requirements for your neighbor’s property line by two feet. The ZBA has the authority to grant permission for a variance enabling you to make this addition to your home. Neighbors located within 250 feet of the proposed variance request are notified by certified mail as to when the matter would be heard. This affords neighbors ample opportunity to review the request and appear to express concern for or support of the project. They also review and decide upon certain special use permits such as accessory apartments applications.
